In 2023, when the Safety Advice Card published to property owners within the Public Information Zone by the Runcorn Site COMAH Operators was amended, the severity of impact on public health was drastically altered. The time period when the public was denied the opportunity of acting in an informed manner was some 20 years:- 

From: the date of first publication in 2003

To: the date of Safety Card Correction in 2023

In 2023 the failings of the Runcorn Site COMAH Operators, the Environment Agency, and the Health & Safety Executive was revealed and made public when the advice of the revised COMAH Zone Safety Advice Card declared the true risk to those in the COMAH Zone, due to the DEADLY nature of small concentrations of Chlorine Gas, not previously publicised.

You should have been aware of the Safety Card, first published in 2003, which is distributed to property owners and revised every 5 years. 

Properties which could possibly be inundated with fatally toxic gas are worth much less than properties which are always safe to live in.

When you come to sell your property, your intending purchaser is very likely to require a mortgage. In the post 2023 circumstances, it is likely that valuers will caution prospective lenders about the advisability and risks of lending on what is now severely impaired security. 

Mortgageability on normal terms, or at all, is now highly questionable.

Who is going to lend where the property could be inundated with fatally toxic gas with a minimum of warning?

For this compelling reason, your property's saleability & value are adversely affected.

By signing below, I/We hereby instruct and authorise Bailey Dyson International Consultants Limited to assist us in preparing and managing our claim for compensation arising from losses caused by some of the Runcorn Site COMAH Zone Operators and the Environment Agency and the Health and Safety Executive, when it was revealed and made public at the time the revised COMAH Zone Safety Advice Card declared the true risk to those within the COMAH Zone, due to the deadly nature of small concentrations of chlorine gas, not previously publicised.


I/We hereby authorise Bailey Dyson International Consultants Limited to share our personal information with members of the highly experienced legal team that has been assembled to act on a conditional / contingency (no win / no fee) basis, with no outlay or (through insurance) no liability to the affected property owners and occupiers.


I/We understand that a third party funder will be sourced to shoulder the ongoing costs involved in pursuing the Class Action Compensation Claims, which will be prosecuted at no cost to the participating property owners.


I/We understand that the third party funder will be entitled to 35% of the gross amount of compensation settlements (property owner share 65%), from which they will recoup the moneys they have expended & already paid, or intend to pay, to members of the professional team involved in delivering the successful result, to include:- Bailey Dyson International Consultants Limited, the legal team, as well as disbursements and court fees.

Complaints Handling Procedure

Bailey Dyson International Consultants Limited is Regulated by the Royal Institution of Chartered Surveyors (RICS) and operate a Complaints Handling Procedure, a copy of which is available upon request.

Dispute

In the unlikely event of any dispute arising, it is to be settled in accordance with Bailey Dyson International Consultants Limited's Complaints Handling Procedure through a third party arbitration process.

Contracting Party

It is the Company, Bailey Dyson International Consultants Limited (no. 09210713) with which your entire business relationship will exist. No personal liability will be created with the Chartered Surveyor who attends to the work.
